CONDITIONS OF ENTRY
1. Information on how to enter and prizes form part of these Conditions of Entry. Entry into this promotion is deemed acceptance of these Conditions of Entry by each entrant. Entry must be made via Internet or SMS (premium call rate applicable) using SMS (short messaging service) enabled mobile phones. Some service providers and call plans may not provide access to premium SMS. Entrants must check with their service provider if unsure.
2. Any costs associated with accessing the promotional website remain the responsibility of each entrant and are dependent on the Internet service provider used. Any contact details entered incorrectly on the website shall be deemed invalid and will result in an ineligible entry.
3. Entry into the promotion is only open to Australian and New Zealand residents who make a Qualifying Purchase (as set out in Conditions 5 and 6 below) during the promotional period. Entrants entering via SMS must be identified as having a clear relationship with the end mobile device (evidenced by entrants entering by an SMS message originating from an MSISDN that identifies the entrant) and entrants entering via SMS or telephone must have the bill payer’s consent to enter. Employees (and their immediate families) of the Promoter and printers, suppliers, providers and agencies associated with this promotion are ineligible to enter.
4. The promotion commences at 12:01am (AEST) on 19/5/2008 and closes at 11:59pm (AEST) on 29/6/2008. The Daily Prize draws will take place every day from 19/5/2008 until 29/6/2008 (inclusive) at 11:00am (AEST). The Level 2 Prize draws will take place on the dates specified in Condition 19 below at 2:00pm (AEST). The Major Prize draw will take place on 30/6/2008 at 10:00am (AEST). All prize draws will take place at Oxygen Interactive Marketing, 2-6 Glenferrie Road Malvern VIC 3144. The Daily Prize winners will be notified by SMS, mail or email. The Level 2 Prize winners will be notified by SMS, mail or email and the names and localities of winners of Level 2 Prizes valued at over $100 will be notified in The Australian or the New Zealand Herald on the following dates: For prizes awarded between 20/5/2008 – 13/6/2008 (inclusive): 17/6/2008; for prizes awarded between 14/6/2008 – 30/6/2008 (inclusive): 4/7/2008 The Major Prize winners will be notified by SMS and mail or email and their name and locality will be published in The Australian or the New Zealand Herald on 4/7/2008. All reasonable steps to notify winners of the results of the draws will be taken by the Promoter. Judges' decision is final and no correspondence will be entered into.
5. To enter the promotion, eligible entrants from Australia must first, during the promotional period, make a Qualifying Purchase, obtain an entry form from the point of sale at the relevant participating store and locate the unique code on the entry form. Qualifying Purchases are:
a. Any purchase from participating Brumby’s store in Australia valued at $6.50 or more;
b. The purchase of at least one (1) Box of Donuts from a participating Donut King store in Australia
c. The purchase of any “Perfect Pair” coffee and cake combination from a participating Michel’s Patisserie store in Australia
d. The purchase of a whole wrap and small coffee from a participating Bb’s store in Australia in a single transaction
6. To enter the promotion, eligible entrants from New Zealand must first, during the promotional period, purchase a Toasted Gourmet Panini and Small Coffee from a participating bb’s store in New Zealand in a single transaction (a Qualifying Purchase for New Zealand entrants), obtain an entry form from the point of sale area of the participating bb’s store and locate the unique code on the entry form.
7. Eligible entrants must then, during the promotional period:
a. If they are an Australian resident:
i. send an SMS in the required format to 1972 2223. The required SMS format is “UNIQUE CODE” ( space ) ”ENTRANT’S NAME” (space)“POST CODE”
ii. log on to www.rfg.com.au and complete in full in the manner required and submit the online entry form. In order to fully complete the online entry form, eligible entrants will be required to provide their full name , mobile number, email address, residential address, and the unique code printed on the entry form.
iii. If they are a New Zealand resident, SMS 8118- (NZ Call Costs 20 cents ), and provide i “UNIQUE CODE” ( space ) ”ENTRANT’S NAME” (space)“POST CODE”
8. SMS entries must be sent from a mobile phone handset and be identified by a MSISDN (unique mobile SIM number) for security reasons to be eligible. Entrants entering via SMS or telephone must have the bill payer’s permission to enter the promotion or their entry will be invalid. Any form of automated entry using the Internet or any other device or software is invalid. Max SMS cost is $0.55 (including GST). Premium carriers' usual SMS costs may apply in addition to SMS cost to enter. Any SMS submitted after the promotion period has closed will not be included in the promotion and will be charged $0.55 cents (including GST). The charges for all SMS and telephone entry services (as applicable) will appear on each entrant's next phone bill. All queries relating to phone bills should be directed to the entrants' phone carrier.
9. Incomplete, ineligible or incomprehensible entries will be deemed invalid. No responsibility will be taken for lost, late or misdirected entries. Entries must be received by the Promoter during the promotional period. SMS and Internet entries will be deemed to be accepted at the time of receipt and not at the time of transmission.
10. A reply SMS will be sent to each entrant submitting an entry by SMS immediately after their entry has been received, confirming their entry has been successfully received. If an SMS entry is not successful because it is not in the required SMS format or the unique code submitted by an eligible entrant is not recognised by the Promoter as a unique code for the promotion, a “try again” message will be sent to the entrant. The “try again” message will prompt the entrant to check their unique code and resubmit their SMS entry in the required format. If the entrant elects to resubmit their SMS entry, the entrant will be charged an additional $0.55 cents (including GST).
11. Multiple entries will be accepted but entrants are limited to one entry per unique code and on each occasion eligible entrants must fully comply with the entry requirements . (Revised)
12. Each eligible entrant must retain and may be required to present proof of purchase in order to claim a prize. Instant winners of daily food prizes must show mobile message with matching code and entry form to counter staff to redeem their prize. Winners of second level prizes and major prizes must also provide their entry form to claim their prize. Entrants may be requested to provide to the Promoter proof of purchase for all entries made. If an entrant is unable to provide proof of purchase for all entries made, then all the entries of that entrant will be ineligible and deemed invalid. Proof of purchase includes showing the original entry form containing the unique code for each purchase made.
13. Entrants can only enter in their own name. The Promoter reserves the right to request the winners to produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the winners’ identity, age, residential address, eligibility to enter and claim a prize, that the entrant obtained the bill payer’s consent to enter by SMS before submitting their entry/entries (if applicable), that the entrant has a clear relationship with the end mobile device used to enter via SMS (if applicable), and any information submitted by the winners in entering the promotion before issuing a prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or the winning entry has not been verified or validated to the Promoter’s satisfaction within the time requested, the winner’s entry will become invalid. The prizes will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.
14. Daily Prizes: A total of 75 Daily Prizes will be issued each day between 19/5/2008 and 29/6/2008 (inclusive) The Daily Prizes are set out below and will be awarded as follows:
a. The first eligible entry randomly drawn from all eligible entries received as at the date of the relevant draw will win one (1) $25.00 Just Jeans Voucher.
b. The next fourteen (14) eligible entries randomly drawn from all eligible entries received as at the date of the relevant draw will each win one (1) Video Ezy Greatest Movies of All Time DVD (to be nominated by the Promoter in its sole discretion), each valued at up to $15.00 (Recommended Retail Price including GST).
c. The next seven (7) eligible entries randomly drawn from all eligible entries received as at the date of the relevant draw will each win one (1) Fox Movie DVD (to be nominated by the Promoter in its sole discretion), each valued at up to $15.00 (Recommended Retail Price including GST).
d. The next eleven (11) eligible entries randomly drawn from all eligible entries received as at the date of the relevant draw will each win one (1) PPS Hair Care Pack, each valued at up to $10.00 (Recommended Retail Price including GST).
e. The next two (2) eligible entries randomly drawn from all eligible entries received as at the date of the relevant draw will each win one (1) Sanity Music Download Card, each valued at up to $10.00 (Recommended Retail Price including GST) [ on card)
f. The next five (5) eligible entries randomly drawn from all eligible entries received as at the date of the relevant draw will each win one (1) voucher for a small coffee and a muffin to be redeemed at a participating Bb’s store in Australia or New Zealand (as applicable), each valued at up to $7.00 (Recommended Retail Price including GST).
g. The next five (5) eligible entries randomly drawn from all eligible Donut King entries received as at the date of the relevant draw will each win one (1) voucher for a regular coffee and donut to be redeemed at a participating Donut King store in Australia or New Zealand (as applicable) each valued at up to $6.00 (Recommended Retail Price including GST).
h. The next ten (10) eligible entries randomly drawn from all eligible Michel’s Patisserie entries received as at the date of the relevant draw will each win one (1) voucher for a Perfect Pair Deal consisting of a small coffee and slice of cake, to be redeemed at a participating Michel’s Patisserie store in Australia or New Zealand (as applicable) each valued at up to $5.90 (Recommended Retail Price including GST).
i. The next ten (10) eligible entries randomly drawn from all eligible Brumby’s entries received as at the date of the relevant draw will each win one (1) voucher for a Glen Loaf to be redeemed at a participating Brumby’s store in Australia or New Zealand (as applicable), each valued at up to $5.10 (Recommended Retail Price including GST).
j. The next ten (10) eligible entries randomly drawn from all Australian eligible entries received as at the date of the relevant draw will each win one (1) voucher for a 600ml bottle of Coke to be redeemed at, each valued at up to $2.80 (Recommended Retail Price including GST).
15. Entries for a given day that are not drawn as a winning entry for that day’s Daily Prize draw are eligible for subsequent Daily Prize draws
16. If there is no eligible entry received by the Promoter on a given day, then the prizes allocated to that day will be reallocated to the next day’s Daily Prize draw
17. In respect of the Daily Prizes listed in Condition 14 (a) – (e) (inclusive), winners must call 1300 737 728 (free call) and follow the prompts to redeem their prize In respect of the Daily Prizes listed in Condition 14 (f) – (i)(inclusive), winners must present their winner notification (SMS, mail or email) and entry form containing their unique code to point of sale staff at the relevant store to redeem their prize.
18. Level 2 Prizes: Level 2 Prizes are as follows:
a. Dreamword and Whitewater World Holiday: one (1) holiday for two (2) adults and two (2) children (aged 0 – 12 years inclusive) valued at up to $11,200.00 (Recommended Retail Price including GST, depending on point of departure). If the winner is aged under 25 years, one travel companion must be aged 25 years or older and satisfy the provisions of Condition 27 in order for the winner to be eligible for the car hire component of the prize. Each Dreamworld and Whitewater World Holiday includes:
i. Two (2) adult and two (2) child (as applicable) return economy airfares to the Gold Coast or Brisbane (to be nominated by the Promoter or its agents) from the Australian or New Zealand capital city airport nearest to the ordinary residential address of the winner (as applicable). Prize includes airfare related taxes and charges. If the winner’s usual residential address is within a 3-hour drive or 240km (in the Promoter’s sole discretion) from Dreamworld and WhiteWater World, this component of the prize will not apply;
ii. Three (3) nights accommodation at a minimum 3.5 star hotel
iii. One (1) 2 day World Pass to Dreamworld and Whitewater World (with unlimited dual access to parks) for 2 adults and 2 children 0-12 years inclusive .
iv. If the winner or one of their travel companions fulfils the criteria set out in Condition 19(a) above, car Hire for four (4) days . If the winner’s usual residential address is within a 3-hour drive or 240km (in the Promoter’s sole discretion) from Dreamworld and WhiteWater World, this component of the prize will not apply; and
v. One hour exclusive use of Nickelodeon Central including private breakfast with the characters for the winner and their travel companions, at a time and date to be advised by the Promoter
b. Fiji Holiday: one (1) holiday for the winner and one (1) travel companion (aged 18 years or older valued at up to $3,712.00 (Recommended Retail Price including GST, depending on point of departure). Each Fiji Holiday includes:
i. Two (2) adult return economy airfares to Fiji from the Australian or New Zealand capital city airport nearest to the ordinary residential address of the winner. (as applicable). d. Dreamworld Family Pass: one (1) Dreamworld Family Pass valued at up to $218.00 (Recommended Retail Price including GST). Passes are subject to prevailing terms and conditions of use and expire on the expiry date set out on the Pass. The winners are responsible for their own travel to and from Queensland and accommodation in Queensland (if required).
e. Cadbury Hamper: one (1) Cadbury Hamper valued at up to $45.00 (Recommended Retail Price including GST).
19. Level 2 Prizes will be drawn as follows:
1 x Dreamworld Pass and 1 x Whitewater World Pass will each be drawn on the following dates: May 20th to 23rd inclusive, May 26th, May 28th to 30th inclusive, June 2nd,3rd , 5th , 6th , 9th, 11th, 13th, 16th, 18th ,20th , 23rd , 25th June 2008.
1 x Fiji Holidays will be drawn: May 26th , June 2nd , 9th , 16th , 23rd and 2 x Fiji Holidays will be drawn on June 30th 2008.
1 x Beefmaster BBQ will be drawn on the following dates: May 26th , June 2nd , 9th and 16th 2008
1 x Cadbury Hamper will be drawn on the following dates: May 26th , June 2nd , 9th , 16th , 23rd and June 30th 2008

i. One (1) oven valued at up to $1099.00 (Recommended Retail Price including GST);

In respect of the prizes listed in Condition 19(a) and (b), all other costs including additional meals, beverages, laundry services, petrol, road tolls, spending money, transport to and from airport departure point, taxes (including applicable arrival and departure taxes in Fiji or Queensland, Australia as applicable), insurance, travel insurance, additional car insurance, passports and visas and all other ancillary costs not expressly provided, as well as obtaining any of these, are the responsibility of the winners and their travel companions. The prizes cannot be used in conjunction with any other discounts or special offers. Passes and tickets issued as part of the prizes are subject to prevailing terms and conditions of use and any tickets or passes issued as part of the prizes which remain unused after the expiry date stated on the tickets or passes (or the final date of the prize trip, whichever is earlier) shall be deemed null and void.
20. In respect of the prize listed in Condition 19(a) and (b), the winners are responsible for their entry, and the entry of their travel companions, into Fiji or Queensland, Australia (as applicable), including the obtaining at the winner’s expense, and holding, of any necessary passports and visas. The winners and their travel companions are responsible for obtaining (and the cost of obtaining) medical advice prior to taking the prize and obtaining any recommended vaccinations and immunisations in the manner required before travelling. Taking the travel prize is subject to any prevailing terms and conditions of any accommodation/transport/services/transfers or tour providers, and in particular, health, behaviour, age and safety requirements. No compensation will be payable if a winner, or their travel companion, are unable to use any element of the prize as stated for whatever reason, including refusal of entry or departure into or out of Fiji or Australia (as applicable) or participation in certain activities for health, age, behaviour or safety reasons. Any part of a prize that is not taken for any reason is forfeited.
21. In respect of the prize listed in Condition 19(a) and (b), the winners and their travel companions will not accrue any frequent flyer points from taking the prize. All components of the prize must be taken together. Accommodation at all hotels and travel is subject to booking, accommodation and flight availability. Once booked, any changes made to the booking may incur a cancellation fee or amendment fee, at the cost of the winners. Travel and accommodation is to be arranged by the Promoter and/or a licensed travel agent nominated by the Promoter.
22. In respect of the prize listed in Condition 19(a), the prize is subject to availability and cannot be taken during Australian school holidays (in any Australian State/Territory) or during Gold Coast Indy Season, and is valid for a period of 6 months from the original draw date. No extension of these travel dates will be permitted. The winners will be required to provide at least 4 weeks notice of intent to travel. All additional costs incurred whereby the prize winner wishes to make variations to the prize details outlined in condition 19(a) above are the winner’s responsibility and must be booked separately by the winner. All travel variations are subject to approval by Macquarie Leisure Operations upon booking. Selection of all travel components (including airline, flight, accommodation and car hire) will be at the discretion of Macquarie Leisure Operation’s at time of booking.
23. In respect of the prize listed in Condition 19(b), the entire prize must be booked and travelled in full by 31/3/2009 otherwise the entire prize is forfeited. No extension of these travel dates will be permitted. Blackout periods may apply, including but not limited to 1/6/2008 – 31/7/2008; 1/9/2008 – 30/9/2008; and 15/12/2008 – 5/1/2009 (all dates inclusive).
24. In respect of the prize listed in Condition 19(a), the car hire vehicle will be available upon arrival at Queensland, for pickup from the airport and drop off on departure. Car rental is for hire of a medium size manual car or vehicle of a lesser value. Rate for car hire includes unlimited kilometres.. Vehicle is subject to availability and the car-rental company's normal rental terms and conditions. It is a condition that the hirer be 25 years and over, and hold a current valid Australian or New Zealand driver's licence. Provisional licences and learners permits will not be accepted. The Promoter accepts no responsibility for damage, mistreatment or ill manor to the hire car caused by the hirer. The Promoter will not be liable for any additional expenses incurred by the hirer through mistreatment, illegal behaviours, or a violation of the car hire's terms and conditions of use. The car hire only covers the day rate hire of the car. All insurance, petrol, fines and damage costs, and any other related expenses, will be the responsibility of the winner and their travel companion. The winner will need to present a current credit card for security purposes upon collection of the vehicle.
25. In respect of the prize listed in Condition 21(a), the Promoter makes no warranties and accepts no liability in relation to the vehicle, its condition or fitness for any purpose. All warranty claims should be directed to the applicable manufacturer and not the Promoter. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion. All ancillary costs or accessories not expressly provided are the responsibility of the winner.
26. All vouchers issued as prizes or parts of prizes are subject to prevailing terms and conditions of use and expire on the expiry date set out on the vouchers. All warranty claims in respect of the prizes must be directed towards the applicable manufacturer and not the Promoter.
27. The total prize value is up to $134,978 (Recommended Retail Price including GST). Prizes must be taken as offered and cannot be varied. Prizes are not transferable or exchangeable and cannot be taken as cash. Any unused portion of the prize is non-transferable, non-refundable and non-redeemable for other goods or services and cannot be taken as cash. Prize values are correct at the time of printing and the Promoter is not responsible for any variation in prize value. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought.
28. The Promoter may conduct such further draws as are necessary at 4:00pm (AEST) at the same place as the original prize draws on 6/10/2008 in order to distribute any prizes unclaimed by that date, subject to any written directions given under Regulation 37 of the Lottery and Gaming Regulations 1993 (SA) or other Australian State or Territory or New Zealand legislation (as applicable). All winners in any unclaimed prize draw will be notified by SMS, mail or email and the name and locality of winners of prizes valued at over $100 will be published in The Australian and the New Zealand Herald as applicable) on 10/10/2008.
29. It is a condition of accepting the prize listed in Condition 19(a) that the winners are aged 18 years or older and that any children travel companions must be accompanied by their parent or legal guardian. It is a condition of accepting the prize listed in Condition 19(b) that the winners (and their travel companions) are aged 18 years or older It is also a condition of accepting the prizes listed in Condition 19(a) and (b) that the winners (and their travel companions) may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
30. If any prize or element of a prize becomes unavailable for any reason beyond the Promoter’s reasonable control then a similar prize or prize element of equal or greater value (including an alternative travel prize to an alternative destination at an alternative date as specified by the Promoter, where applicable) will be awarded to the winner in lieu, subject to any written directions made under applicable Australian State or Territory or New Zealand legislation (as applicable).
31. In the event of war, terrorism, state of emergency or disaster (including natural disaster) or any other circumstance beyond the reasonable control of the Promoter, subject to any applicable laws or written directions made under applicable Australian State or Territory or New Zealand legislation (as applicable), the Promoter reserves the right to either provide an alternative travel prize (including an alternative travel prize to an alternative destination at an alternative date as specified by the Promoter) to the same value as the original prize or to cancel, terminate, modify or suspend the promotion.
32. The Promoter and its associated agencies and companies shall not be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with using any prize, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
33. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry which is not in accordance with these Conditions of Entry, or if the entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
34. Caution: any attempt to cause malicious damage or interference with the normal functioning of the SMS applications, the promotional website or the information on the promotional website, or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these conditions of entry or any other legal obligation by an entrant, the entrant agrees to indemnify the Promoter for those losses, damages and costs.
35. The Promoter is not responsible for any problems or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a mobile network, or any combination thereof, or any other technical failures including any damage to entrant's or any other person's mobile handset or computer related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.
36. If for any reason this promotion is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion, subject to any written directions under Australian State or Territory or New Zealand legislation (as applicable).
37. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
38. SMS is not a guaranteed delivery communication tool. The Promoter and the service provider cannot accept responsibility for any SMS messages not received.
39. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter.
40. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner of a draw (including photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration or compensation for the purpose of promoting, publicising or marketing this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. The winners agree to participate in all reasonable promoted activities in relation to the Promotion as requested by the Promoter and its agents.
41. All entries and any copyright subsisting in the entries become and remain the property of the Promoter. The Promoter collects personal information about entrants to include entrants in the promotion and where appropriate award prizes. If the personal information requested is not provided, the entrant may not participate in the promotion. By participating in the promotion, each entrant also acknowledges that a further primary purpose for collection of entrants’ personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact entrants in the future with information on special offers or provide entrants with marketing materials via any medium including mail, telephone and commercial electronic messages. The Promoter may share information with its Australian related companies or promotional partners who may contact entrants with special offers in this way. By entering the promotion, each entrant agrees that the Promoter may use entrants’ personal information in this manner. Each entrant also agrees that the Promoter may publish or cause to be published the winner’s name and locality in any media. Entrants can also gain access to, update or correct any personal information by contacting the Promoter at the address below. All personal information will be stored at the office of the Promoter. A copy of the Promoter’s Privacy Policy in relation to the treatment of personal information collected may be obtained by contacting the Promoter.
